Notice of the contempt application is yet to be served upon the alleged contemnor being the Chairman of the Rajpur-Sonarpur Municipality. However, learned advocate representing the alleged contemnor appears and produces a copy of the reasoned order passed by the Municipality on November 9, 2023. The order was duly communicated to the petitioner.

As it appears that the Municipality had considered the prayer of the petitioner and passed reasoned order, accordingly, there is no requirement of proceeding with the contempt application any further. If the petitioner is aggrieved by the order passed by the Municipality, it will be open for the petitioner to challenge the same before the appropriate forum in accordance with law, if so advised.

The contempt application stands disposed of.

The communication made by the Municipality to the petitioner along with the reasoned order be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
