1. Learned counsel appearing for the petitioner submits that the principal accused in this case being the husband of the victim is in custody. Although the case was started with an allegation of murder, charge-sheet has been submitted with an allegation of abetment of suicide. On 6th May, 2025 this Court granted anticipatory bail of three similarly circumstanced co-accused in CRM (A) 1488 of 2025 and CRM (A) 2145 of 2025.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. However, he submits that the present petitioner being the uncle-in-law of the alleged victim is substantially on the same footing as the motherin-law of the victim.
3. Considering the materials available in the case diary and the fact that the principal accused being the husband is
in custody and other similarly circumstanced co-accused have been granted anticipatory bail by this Court and the fact that charge-sheet has been submitted, I am inclined to grant anticipatory bail to the petitioner.
4. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall not threaten or intimidate witnesses. The petitioner shall surrender before the learned Trial Court and pray for bail within four weeks from date.
5. Accordingly, the instant application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
