Mr. Aniket Mitra ... for the State Learned Counsel appearing for the petitioner submits he is in custody for 110 days. He prays for bail. Learned Counsel appearing for the State opposes prayer for bail.
We have considered materials on record including statement of the minor victim recorded under Section 164 of the Code of Criminal Procedure. From her statement it appears that the petitioner had forcibly raped her.
Under such circumstances and as date has been fixed for recording evidence, we are not inclined to grant bail to the petitioner at this stage.
