Rajjak Sk@Bachha@Saikh v. State Of West Bengal
02.08.2023.
33.
Ct.No.28 as (Rejected) C.R.M. (DB) 3045 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Patuli P. S. Case No.139 of dated 16.12.2011 under Sections 364A/120B of the Indian Penal Code.
In the matter of : Rajjak Sk @ Bachha @ Saikh. ... Petitioner.
Mr. Moinak Bakshi, Ms. Pramita Banerjee.
...for the Petitioner.
Ms. Zareen N. Khan, Mr. Asif Dewan.
...for the State.
Petitioner is in custody for 11 years. He prays for bail. Learned Advocate for the State opposes the bail prayer. He submits report.
We have considered the materials on record. From the report, it appears that trial has progressed considerably. Witnesses have identified the petitioner in Court as one of the persons who collected the ransom money. Only three witnesses are yet to be examined.
Under such circumstances and in view of gravity of offence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
We request the trial court to conclude the examination of the remaining witnesses and conclude the trial within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
Parties shall communicate this order to the trial court for due compliance.
