It is contended on behalf of the petitioner that the State authorities have utilized the plot of land belonging to the petitioner, though no notice under Section 4(1a) of the West Bengal Land (Requisition & Acquisition) Act, 1948 was issued upon him. However, the Act of 1948 lapsed in the meantime.
It is submitted on behalf of the State respondents that since the land of the petitioner has been utilized by the State authorities, the authorities are agreeable to direct purchase of the land from the petitioner in terms of Memorandum No.756-LP/1(A)-03/14 (Pt-II) dated 25th February, 2015.
The petitioner also agrees to the said proposal of the State.
In view of the same, the writ petition is disposed of by directing the 7th respondent to initiate proposal for direct purchase of the land in question in terms of Memorandum No.756-LP/1(A)-03/14 (Pt-II) dated 25th February, 2015 and conclude the said process within a period of four months from the date of communication of this order upon granting reasonable opportunity of hearing to the petitioner, in accordance with law.
The decision taken by the authority shall be communicated to the petitioner within a week thereafter. With the above directions, the writ petition being W.P.A. 19242 of 2021 is thus disposed of. However, there shall be no order as to costs.
Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
