The petitioner complains of alleged inaction on the part of the Namkhana Police. The petitioner is aggrieved that the private respondents are disturbing cultivation on his plot of land. There is also an allegation of physical assault.

The private respondents are represented and submit that no notice of upgradation of the matter has been given to them.

Learned counsel for the State submits that Namkhana Police have already taken out proceedings under section 107 of the CrPC.

This Court is of the view that the disputes between the petitioner and the private respondents are civil in nature. Appropriate civil proceedings may be taken out by the petitioner in this regard.

Namkhana Police shall, however, ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the writ petition shall stand disposed of.

7.

There shall be no order as to costs.

8.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
