1. Parties are represented through their respective learned counsels.

2. With consent finally heard.

3. The challenge is mounted in this petition to the order dated 30.06.2025 passed by the Central Administrative Tribunal, Kolkata Bench in OA No.350/668/2025. The Tribunal by the said order remitted the matter back to the authorities to reconsider the case of the present petitioner taking into account the latest physical condition recorded by Medical Board and other medical documents. In turn, respondent passed order dated 16.08.2025.

4. In our opinion, there is no occasion for us to examine the correctness of the impugned order dated 30.06.2025. Pursuant to the said order, final order

dated 16.08.2025 has already been passed. The fresh order gives fresh cause of action to the petitioner and the same can be called in question before the Court of the first instance, namely, the Central Administrative Tribunal (CAT). Reference may be made to the Constitution Bench judgment of the Supreme Court in the case of Union of India vs. L. Chandra Kumar reported in 1997 (3) SCC 261. Considering the aforesaid, we find no reason to entertain this petition. Accordingly, the petition is disposed of by reserving liberty to the petitioner to assail the rejection order dated 16.08.2025 before the appropriate forum.

Considering the nature of litigation and crisis shown by the petitioner we expect that the Tribunal will make all endeavour to decide the matter at the earliest.
