The revisional application was preferred challenging the continuance of Gaighata P. S Case No. 786 of 2021 dated 31.08.2021 under Sections 408/420/120B of the Indian Penal Code.
As none appears on behalf of the State. Mr. Imran Ali, learned advocate who ordinarily appears on behalf of the State is directed to appear on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. The allegations made in the F.I.R by the complainant related to transactions being committed by the accused by way of which the accused was involved in manipulation of accounts of the complainant company namely Lexicon Commercial Enterprise Limited. In the present revisional application, the petitioner has produced certain documents in support of his contentions advanced in the revisional application.
I have considered the contentions as well as the documents which have been enclosed and I am of the view that the same are question of facts which can be dealt with by the Investigating Agency. This court while exercising its powers under Section 482 of the Code of Criminal Procedure will not entertain a prayer for quashing on the basis of documents which are exclusively private and personal in nature. Consequently, the present revisional application being CRR 2998 of 2022 is dismissed.
Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
