Counsel for the Punjab National Bank has relied upon a judgement of the Hon'ble Supreme Court dated 21st June, 2023 in Civil Appeal No(S).624 of 2017 in the case of Bank of Baroda and Ors. Vs. Baljit Singh. 2.
In the said decision the Rules of the Bank of Baroda for compassionate employment permitting the pension payable on account of the deceased employee, for the purpose of ascertaining financial condition of the family for compassionate employment, has been upheld. All nationalized banks should follow similar Guidelines and Rules that are generally adopted upon being framed by the "Indian Banks Association".

In view of the above, this Court is of the view that the decision of the Bank in taking into consideration, the terminal benefits of the deceased employee for the purpose of assessment of financial situation of a family, while considering compassionate employment, based on its rules, cannot be faulted.

For the reasons stated hereinabove, the writ petition is disposed of.

There shall be no order as to costs.
