Anita Jana .....petitioner Mr. Pronojit Roy Mr. Arindam Bit ...... for the petitioner The present revisional application has been preferred seeking direction upon the court of the learned Judicial Magistrate, 3rd Court, Contai, Purba Medinipur, for expeditious disposal of the proceeding being C.R. Case No. 217 of 2023, (subsequently renumbered as 233 of 2023) arising out of an application under Section 138 of the Negotiable Instrument Act. Mr. Roy, learned Advocate appearing for the petitioner, submits that the complaint was filed in 2023. After examination of the petitioner under Section 200 of the Code of Criminal Procedure (for short "Code"), the process was issued. The accused entered appearance but took adjournment on several occasions. He claims that due to non-cooperation of the accused person, the case could not be concluded. He also submits that next date for plea has been fixed on 30th January, 2026.

Having heard the learned Advocate appearing for the petitioner and upon perusal of the materials on record, I am of the view that there is no use of keeping this revisional application pending. I do not find any impediment in accepting such an innocuous prayer made on behalf of the petitioner. In view thereof, this revisional application is allowed. Learned Judicial Magistrate, 3rd Court, Contai, Purba Mednipur, is directed to make a sincere effort to dispose of the C.R. Case No. 217 of 2023 (subsequently renumbered as 233 of 2023) as expeditiously as possible preferably within a period of eight months from the next date fixed for hearing i.e. from 30th January, 2026.
