Petitioner prays for anticipatory bail.
Learned Advocate appearing for the petitioner submits that the parents of the de facto complainant came to the matrimonial house of the de facto complainant. There an altercation took place. The mother of the petitioner lodged a police complaint.
Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. He submits that the petitioner assaulted his father-in-law with the brick by reason of which the father-in-law suffered hurt. Considering the materials in the case diary, the nature of involvement of the petitioner in the incident and considering the fact that the petitioner is the husband and considering the fact that the police complaint was lodged within five years of the marriage, we are unable to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 3960 of 2022 is dismissed.
