Sibani Bhagat v. C.E.S.C.
07.01.2026 Sl.No. 66 Ct.No. 32 Amalranjan In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side WPA 19228 of 2006 SMT. SIBANI BHAGAT VS C.E.S.C.
Mr. Aayush Sharma ...for the CESC
1. The instant writ petition has been filed by the writ petitioner praying, inter alia, to direct the respondent no. 1 and/or its sub-ordinates, agents or men to supply electricity through a new/separate meter immediately in the name of the petitioner at Premises No. 43, Watgunge Street, Kolkata -700023, 3rd Floor, Southern Portion, Eastern Side.
2. None appears on behalf of the petitioner on call. No accommodation is sought for.
3. This case pertains to the year 2006. Almost 19 years have already passed.
4. Considering the nature of prayer and long pendency of this case, this court would like to dispose of the case on merits on the basis of documents available on the record.
5. Upon perusal of the documents particularly annexed as P-1 in the writ petition, it is
revealed that a letter was issued by the District Engineer, South West District vide Reference no. 02/81466/06 dated 06.04.2006, wherefrom it appears that the writ petitioner was intimated that some outstanding dues in respect of consumption of electricity was lying recoverable at the above premises.
6. It was necessary for them to investigate the matter before any further action can be taken in this regard. It was further mentioned, inter alia, as under:- "Please note that once the issue relating to outstanding dues is resolved, we shall intimate the petitioner in writing the date of site inspection and if found suitable, the offer letter will be forwarded in due course".
7. After lapse of 19 years, it seems either the electricity connection has been restored to the petitioner or denied.
However, nobody represented the petitioner to apprise this court about the present status of the case.
8. In view of the above facts, this court deems it appropriate to dispose of this case by directing the writ petitioner that if the electricity has not been restored as yet, she may approach the appropriate authority for supply of electricity afresh in accordance with law and if such
application is made by the petitioner, the concerned respondent authority will consider her prayer for supply of electricity connection in accordance with law forthwith.
9. With the above observations and direction, the instant writ petition being WPA 19228 of 2006 is disposed of.
10. Consequently, the connected application, if any, is also, thus, disposed of.
11. Interim order, if any, stands vacated.
12. All parties shall act in terms of the server copy of this order duly downloaded from the official website of this Court.
13. Urgent certified photocopy of this order, if applied for, be supplied to the parties taking all legal formalities.
