This is an application for special leave to appeal under Section 378(3) of the Code of Criminal Procedure against an order passed by the Learned Metropolitan Magistrate, 18th Court, Calcutta in CS No. 32819/2015 corresponding to TR No. 7626/2015 and CIS No. CS/26252/2015. By passing the order impugned under Section 255(1) of the Code, the Learned Magistrate acquitted the accused/respondent from the above-mentioned case under Section 138 of the Negotiable Instrument Act.
I have heard Mr. Bhattacharyya. Perused the impugned order. The special leave to appeal is allowed. The applicant is directed to file the memorandum of appeal within 30 days from the date of this order. ( Bibek Chaudhuri, J. )
