......for the petitioners Dr. Sutanu Kumar Patra Ms. Supriya Dubey ....for the WBCSSC Matter is heard in presence of learned advocates representing the petitioners and West Bengal Central School Service Commission.

It is submitted by learned advocate representing the petitioners that they are TET qualified candidates and participated in 1st SLST 2016 (Upper Primary). It is further submitted that due to personal difficulty petitioners could not upload there testimonials for verification in the second phase of selection process which started from Rule 12(2) stage and subsequently grievance could not be raised before the Grievance Redressal Committee which was constituted by the respondent authorities. Now, petitioners pray for direction upon respondent authorities to permit them to upload their testimonials for verification.

Prayer of the petitioners is opposed by learned advocate representing the Commission since time to upload the testimonials in terms of the order of the Hon'ble Court has expired long back and petitioners did not raise grievance before the Grievance Redressal Committee which opportunity was available to them in pursuit of getting remedy. According to the Commission, merit list has already been prepared and counseling is going on.

Having considered respective submissions made on behalf of the parties, it appears that petitioners did not upload their credentials for verification when similarly circumstanced other candidates uploaded their credentials for being considered in connection with 1st SLST 2016 (Upper Primary).

Subsequently though opportunity was extended to the candidates who had grievance relating to uploading their respective credentials on the website of the Commission by raising dispute before the Grievance Redressal Committee, in the present case petitioners did not avail of such opportunity by raising dispute. It is too late in the day to consider petitioners' prayer since merit list has already been finalized and counseling of the candidates whose names featured in the merit list is going on.

Hence, no relief can be granted to the petitioners and the writ petition stands dismissed.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
