Affidavit of service so filed be kept with the record. Mr. Chattopadhyay, learned advocate appearing for the petitioner submits that although the appeal was preferred in the year 2019, yet till date the same has not been heard out and almost three years have passed in the meantime. Learned advocate further submits that the petitioner in the meantime has become jobless and is suffering because of the interim maintenance order passed by the Learned Magistrate.

Mr. Mahapatra, learned advocate disputes the contention advanced by Mr. Chattapadhyay. However he raises no objection if the appeal is heard within a fixed schedule of time. It has been informed that presently the appeal is pending before the Additional Sessions Judge, Fast Track Court at Barasat, District North 24 Parganas. Accordingly, the learned Trial Court is directed to dispose of the appeal by 18th April 2022.

Needles to state this court has not gone into the merits of the contention of dispute and the learned Trial Court would independently consider the submissions and contentions advanced by the parties.

With the aforesaid observations CRR 2434 of 2019 is disposed of.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
