For the State The petitioner seeks consideration of a representation made by him before the concerned authority for curtailment of a portion of the route and extension of another portion. The petitioner is a holder of permanent stage carriage permit in the route Gongra to Plassey via Tehatta-Chapra. He seeks curtailment of the route from Chapra to Gongra covering 12 kms. and extension of the route from Chapra to Krishnanagar covering 15 kms.

Learned counsel for the respondents submits that a combined request for curtailment and extension as made by the petitioner in a single representation cannot be considered by the authority.

The petitioner seeks to submit two separate representations before the concerned authority being the 5th respondent herein requesting curtailment and extension of the route respectively and prays for a direction upon the authority to consider the separate representations at the earliest.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit two separate representations before the 5th respondent within three weeks from date. The 5th respondent is directed to consider and dispose of the representations within six weeks from the date of receipt thereof upon affording reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
