And In Re : Sajjad Ali @ Sajjak Ali .....Petitioner Ms. Minoti Gomes ..........for the Petitioner Mr. Binay Panda Ms. Puspita Saha ..........for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Harishchandra Pur P.S. Case No. 877/2020 dated 07.12.2020 under Sections 341/326/307 adding Section 302 of the Indian Penal Code. Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. It appears that the petitioner's prayer for bail was last rejected on 13th August, 2021 by a coordinate Bench of this Court and we do not find that there had been any substantial change in the circumstances subsequent thereto. In view thereof, the petitioner's prayer for bail is refused at this stage.

Ms. Gomes, learned advocate appearing for the petitioner, however, submits that the petitioner is in custody for about 389 days and there had been no progress in the trial.

In reply, the learned advocate appearing for the State submits that a schedule has been fixed on and from 13th January, 2022 to 15th January, 2022 for evidence. In view thereof, we request the learned trial Court to expeditiously conduct the trial, without granting any unnecessary adjournments to either of the parties and if necessary, upon resorting to steps available under Section 309 of the Code so that logical conclusion of this case may be reached at the earliest.
