The allegation of unauthorised construction made by the petitioners before the Asansol Municipal Corporation was considered and the same has been referred to the Executive Engineer in the month of November 2022 for taking necessary steps as per the West Bengal Municipal Corporation Act and Rules. Learned advocate representing the Corporation submits that the engineer named in the order of the Corporation has retired. The issue will be dealt with by a separate engineer.

Learned advocate representing the private respondent submits that after the order was passed by

the Corporation in November 2022, no communication has been made by the Corporation till date.

As it appears that the issue of unauthorised construction is pending consideration before the Executive Engineer of the Corporation, accordingly, the Executive Engineer of the Corporation is directed to take steps to conclude the proceeding in accordance with law at the earliest but positively within a period of twelve weeks from the date of communication of this order. If unauthorized construction is detected, necessary consequential steps shall be taken to deal with the same in accordance with law.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
