post with the North Bengal State Transport Corporation (NBSTC). The grievance of the petitioners is that despite rendering 20 years of continuous and satisfactory service the second CAS benefits as per the Career Advancement Scheme, 1990 have not been paid to the petitioners. The petitioners have made a representation on December 1, 2022 before the Managing Director, NBSTC. The representation of the petitioners has not been considered till date. Mr. Aftab, learned counsel appearing on behalf of the petitioners submits that the Private Respondent No. 4, though similarly placed have been given the benefits of the second CAS.

Mr. Sen, learned Additional Government Pleader appears on behalf of the NBSTC.

Considering the submissions of the parties and the materials placed on records, this Court directs the Managing Director NBSTC / Respondent No. 2 to dispose of the representation of the petitioners dated December 1, 2022 within 6(six) weeks from date upon giving a personal hearing to the petitioners. A reasoned order shall be passed and communicated to the petitioners within 2(two) weeks of passing thereof. The fact that the Respondent No. 4, though similarly placed has been given the benefits of second CAS shall be taken into consideration, while passing the reasoned order.

With the directions aforesaid, WPA 18211 of 2023 is dismissed.

Since no affidavits have been called for in the writ petition, the allegations contained therein be deemed not to have been admitted by the respondents.

All parties shall act on the server copies of this order duly downloaded from the official website of this Hon'ble Court.
