G.S.Das Mr. Debabrata Sardar ... for the Petitioner(s) Ms. Rupsha Chakraborty ... for the State-respondent(s) The petitioner is aggrieved by the fact that in spite of informing the Inspector-in-charge of Kultali Police Station, no steps have been taken by the police authorities.

The main grievance of the petitioners is that in spite of a title suit (T.S.116 of 2004) being decreed, there has been interference at the behest of the private respondents as also obstruction created by them for carrying out cultivation.

Having considered that the genesis of this information was on the decree

passed by the learned civil court on or about 31.07.2008, I am of the view that the petitioners would exhaust their remedies under the Civil Procedure Code for appropriate directions upon the police authorities.

Since none appears on behalf of the State, Ms.

Rupsha Chakraborty, learned advocate, who ordinarily appears for the State, is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Having considered that the representation which was submitted was dated 02.05.2023 and, more than two years have passed in the meantime, the police authorities, if they face inconveniences, submit a report before the learned civil court. In case, the petitioners face the same inconveniences, they will file a fresh report with the police authorities, who would take action in

accordance with law.

With the aforesaid observations, WPA 18217 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
