Learned counsel for the petitioner-Bank submits that no application has been filed by the private respondents in connection with the pending proceeding under Section 14 of the SARFAESI Act.

It is further submitted that there is no encumbrance in the Section 14 application being decided expeditiously.

I find from the records that the application of the petitioner-Bank under Section 14 of the SARFAESI Act is pending much beyond the outer limit of sixty days as stipulated in law.

Accordingly, WPA 19318 of 2021 is allowed, thereby directing the respondent no.2, that is, the District Magistrate, Purba Burdwan, to dispose of the pending application of the petitioner-Bank under Section 14 of the SARFAESI Act against the private respondents, as expeditiously as possible, positively within three weeks

from the date of communication of this order to the respondent no.2.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
