The petitioner alleges non-compliance of the direction passed in the order dated 27th September, 2019 in W.P. No. 17176(W) of 2019 (Raktim Ranjan Jana- vs - The State of West Bengal & Ors.).

The petitioner has submitted that repeated attempts were made to serve the Pradhan of the Shyampur Gram Panchayet - I but the said authority is intentionally and deliberately refusing to accept the postal article. It has been submitted that lastly the petitioner was able to serve a copy of the order upon the Pradhan of the Gram Panchayet and the track report annexed to the contempt application shows that the order of the Court was received by the Pradhan on 3rd February, 2020. Since it has been complained that the order of the Court has not been complied with by the Pradhan and he is avoiding service of the application, accordingly, the Officerin-Charge of the Shyampur Police Station is directed to

ensure service of a copy of the contempt application upon the Pradhan of the Shyampur Gram Panchayet - I. The petitioner is directed to serve a copy of the contempt application upon the Officer-in-Charge of Shyampur Police Station for forward transmission to the Pradhan of Shyampur Gram Panchayet-I.

The matter is made returnable on 24th February, 2021.

It is needless to mention that pendency of the instant contempt application will not stand in the way of the alleged contemnor to comply the order of the Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
