CAN 1 of 2023 is an application filed by the Executive Engineer, Farakka Barrage Project, praying for an appropriate order regarding payment of land compensation by the Farakka Barrage Project Authority to the land loosers. It appears that pursuant to an order dated January 14, 2025, passed on a writ petition filed by the present petitioners being WPA 27346 of 2023, the Farakka Barrage Project Authorities have deposited the entire land compensation amount with the learned Registrar General of this Court. This would appear from the compliance report in the form of an affidavit affirmed on July 14, 2025 by the Executive Engineer of Farakka Barrage Project, which has been filed in court today.
In view of the aforesaid, leave is granted to the learned Advocate on record for the petitioners to file appropriate
application/representation before the learned Registrar General clearly showing how much compensation each of the petitioners is entitled to. After as much verification as is possible, the learned Registrar General shall disburse the amount to the petitioners in accordance with the calculation submitted by the learned Advocate on record for the petitioners.
A copy of the calculation made by the learned Advocate on record for the petitioners shall be made available to learned Advocate for the Farakka Barrage Project.
I request the learned Registrar General to complete the exercise of disbursement of the funds within eight weeks from the date of receipt of the application/representation from the learned Advocate on record for the petitioners. CPAN 819 of 2022 and CAN 1 of 2023 are disposed of. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
