None appears for the State despite service.
Mr. Sayan Datta, learned counsel who is present in Court and usually appears for the State is requested to represent the State in this matter. His appointment be regularised by the appropriate authority. The petitioner is directed to serve copy of the application along with annexure thereto upon Mr. Datta in course of this day. Learned counsel for the petitioners submits that there is land dispute between the parties and a civil suit is pending wherein the learned Court has directed both the parties to maintain status quo in respect of the nature, character and possession of the property in question. Despite such order, the private respondents are disturbing the peaceful possession of the petitioners in the property in question and threatening them with dire consequences. The petitioners seek protection.
Learned counsel for the private respondents denies and disputes the allegations made by the petitioners. The land dispute between the parties shall be adjudicated by the learned civil Court.
In the meantime, the police authority shall keep strict vigil over the area in order to ensure that no untoward incident takes place and peace and tranquility is maintained. The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
