The petitioners are aggrieved by an order passed under the SARFAESI Act.

It is the contention of the petitioners that the provision of Section 14(2) of the SARFAESI Act has not been followed in this regard and the order of the District Magistrate, Paschim Bardhaman does not indicate whether all the nine points which were required to be mentioned in the affidavit had been mentioned by the bank or not. The District Magistrate has also not recorded any satisfaction.

All these issues can be agitated before the appropriate forum and the remedy of the petitioner is before the learned Debts Recovery Tribunal.

The writ petition is, thus, disposed of.

There shall be no order as to costs.

All parties are to act on the basis of the server copy of this order.
