It is an admitted position that a demolition order has been passed by the Kandi Municipality on August 6, 2024, regarding the unauthorised construction.

Respondent no. 6 submits that he has preferred a statutory appeal under Section 218 (3) of the West Bengal Municipal Act, 1993 before the competent authority against the demolition order.

In that view of the matter, no order need be passed at this stage. Needless to mention that the

appeal preferred by the petitioner should reach its logical conclusion.

WPA 18243 of 2023 is disposed of.
