Learned Counsel for the petitioner and the respective respondents are present.

Mr. De, learned Additional Government Pleader assisted by Mr. Nilotpal Chatterjee, has produced a report in the form of affidavit filed on behalf of the respondent no.2 and urged that in obedience of the Court order dated July 30, 2025, the necessary actions have been taken and the pond in question has been restored to its original character.

Learned Counsel for the petitioner, upon perusal of the said report, expressed his satisfaction and submits that desired relief in the Public Interest Litigation (PIL) has been granted

but since the petitioner has taken public cause, he is getting threatening from the interested persons who suffered Government action in restoration of the pond. Accordingly, learned Counsel for the petitioner submits that the petitioner being an old man, deserves protection from any such threat or action.

Mr. De submits that in that event the petitioner may apprise the local Police by preferring a representation. The representation shall be looked into by the Police in accordance with law and if necessary, the petitioner shall be provided adequate protection.

In this view of the matter, the PIL stands disposed of with the observation that in the event the petitioner receives any threat, it will be open for him to apprise the local Police Station and it shall be the duty of the Police to act with quite promptitude and take action in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case. 8.
