The present revisional has been preferred by the petitioner being aggrieved by the manner of continuance of the proceedings. It has been submitted that the petitioner is in custody since 16.06.2021 and charge-sheet was submitted on 31.07.2021. It has also been contended that the charge in connection with the instant case was framed on 12.04.2022. Learned advocate has also drawn the attention of the Court to the number of witnesses which is eight and all the witnesses belong to the government department.

The petitioner was directed to serve a copy of this revisional application upon Ms. Ratna Ghosh, learned advocate who ordinarily appears for the State.

Her appointment may be regularised by the concerned authorities.

The instant case was registered in the month of June 2021. I have taken into consideration the order dated 25.07.2022 wherein the learned trial court has observed that

more than 1500 NDPS cases are pending and most of the accused persons of the said cases are facing custodial trial. The accumulation of cases before a trial court is for variety of reasons which need not be gone into and analysed in detail. In view of the petitioner being in custody, the learned Special Court is directed to fix the schedule of three dates in connection with the instant case and to fix a schedule at least once in every three months. No unnecessary adjournment should be granted to either of the parties and the public prosecutor conducting the case in the trial court should be directed to give/provide the list of the witnesses and ensure their appearance on the date so fixed by the learned trial court. All efforts must be taken for completing the trial within a reasonable period of time.

With the aforesaid observations, the revisional application being CRR 3014 of 2022 is disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
