Petitioner claims that he was in possession of a land where the private respondents started construction. Petitioner being aggrieved approached the Executive Magistrate. However, till date the concerned officers have not submitted any report. In case the report has not been submitted by Pathar Pratima Police Station, they are directed to submit the same before the learned Executive Magistrate. However, the learned Executive Magistrate has got no authority to pass any direction in respect of the right, title and interest in respect of the property. If petitioner has any grievance he should approach the jurisdictional civil court.

In the meantime police authorities would ensure that there is no breach of peace at the instance of either of the parties and no untoward incident crops up because of the petitioner and the private respondents being a loggerhead.

With the aforementioned observations, the instant writ petition being WPA 19002 of 2024 is hereby disposed of.

Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
