This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Divn.) 1st Court at Barasat, North 24 Parganas to dispose of the Title Suit No.1350 of expeditiously.

The learned advocate appearing for the petitioner, in his usual fairness, submits that the opposite party has not yet entered appearance in the said suit.

From the order-sheets appended to this application this Court finds that Order 40 Rule 1 of the Code of Civil Procedure is pending and November 6, 2025 has been fixed for hearing of such application. In the light of the above submission, C.O. No. 2872 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Divn.) 1st Court at Barasat, North 24 Parganas to take up the hearing of this application under Order 40, Rule 1 of the Code of Civil Procedure on the next date and dispose of the same as

expeditiously as possible, if the same is otherwise ready for hearing without granting any unnecessary adjournment to either of the parties.
