Although proper service has not been effected on the respondents, the State is represented through counsel. In view of the innocuous nature of the prayer sought, further direction of service is not issued. The petitioner submits that, on the complaint of the petitioner, a proceeding was initiated under the Public Land (Eviction of Unauthorized Occupants) Act, 1962 and the same is at present pending before the Collector and Sub-Divisional Magistrate, Diamond Harbour, South 24 Parganas.

The petitioner seeks an early disposal of the same. It seems from the records that the matter is long pending, at least since 2019.

Hence, WPA 19347 of 2021 is disposed of by directing the respondent no.4, the Sub-Divisional Officer, Diamond Harbour Sub-Division to dispose of the

proceeding pending before him at the behest of the petitioner under the 1962 Act, in accordance with law, as expeditiously as possible, positively within four months from this date.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
