Pradip Kumar Roy versus The State of West Bengal & Ors.

Mr. Praloy Bhattacharjee ... For the Union of India. Petitioner approached this Court with prayers for investigation in respect of the information so furnished. I find that the accusations are under the Foreigners Act and addressed to the Inspector-inCharge, Barasat Police Station. Records also reflect that Barasat P.S. Case No. 140 of 2022 under Sections 14A/14B of the Foreigners Act was registered at the relevant period and was pending before the learned CJM, Barasat.

Having considered that a jurisdictional court was in seisin of the issue at the relevant point of time, if the petitioner is aggrieved, petitioner should in the circumstance approach the jurisdictional court which is in seisin of the criminal case for ventilating his grievance. No interference is called for by this Court.

With the aforesaid directions, the writ petition being WPA 19024 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
