...for the petitioner This is an application under Article 227 of the Constitution of India at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 1st Court at Alipore, South 24 Parganas to dispose of the application under Order 22 Rule 2 of the Code of Civil Procedure, filed in Ejectment Suit No. 232 of 2018 expeditiously.

Rajdeep Bhattacharya, learned advocate appearing for the petitioner submits that the said application is pending from November 12, 2024. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocates representing the opposite party before the learned trial judge. From the order sheets appended to this application, this Court finds that the date has been fixed for hearing

of the application under Order 22 Rule 2 of the Code of Civil Procedure on 29th August, 2025, which is pending. In view thereof, CO 2878 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 1st Court at Alipore, South 24 Parganas to dispose of this application under Order 22 Rule 2 of the Code of Civil Procedure, as expeditiously as possible without granting any unnecessary adjournments to either of the parties. After the disposal of such application the learned trial judge shall make an endeavour to dispose of the ejectment suit expeditiously, keeping in mind, that the suit is pending from the year 2018 There will be no order as to costs.
