It is also not in dispute that the petitioner had been enjoying electricity from the common meter board located at premises no. 2/1, which is claimed to be owned by respondent nos. 5 and 6.
It appears that such arrangement for supply of electricity had been continuing for a considerable period of time.
Learned Advocate representing the Calcutta Electricity Supply Corporation (CESC) Limited acknowledges that the electricity connection of both the petitioner and respondent nos. 5 and 6 has been disconnected for want of repair and maintenance of the
old common meter board. It is further submitted that the meter board requires urgent repair to prevent possible fire hazards.
The petitioner prays for restoration of his electricity connection after due repair by CESC Limited. Mr. Banerjee, learned Advocate representing respondent nos. 5 and 6, vehemently opposes the prayer. It is contended that the petitioner cannot be permitted to continue enjoying electricity from a meter board situated within the respondents' premises. It is submitted that there exists a common area where all the meters can be shifted, so that the petitioner as well as respondent nos. 5 and 6 may draw electricity from such common meter board.
It, however, does not appear that, as on date, any application has been made by either of the parties for shifting the meter board. What is of immediate necessity is repair of the existing meter board, and none of the parties should obstruct such work.
Accordingly, the writ petition is disposed of with a direction upon CESC Limited to carry out the necessary repair work of the existing meter board and restore electricity supply to the petitioner within three weeks from date.
An undertaking has been given before this Court on behalf of respondent nos. 5 and 6 that they will not cause any obstruction to the said repair work and
restoration of electricity connection in favour of the petitioner.
In the event respondent nos. 5 and 6 file an application for shifting the existing meter board, the same shall be duly considered by CESC Limited in accordance with law and upon compliance with all requisite formalities.
It is made clear that the repair work directed herein shall be undertaken by CESC Limited irrespective of any prayer for shifting of the meter board. In the event the key to the meter board room is not handed over, CESC Limited shall be at liberty to break open the padlock.
Accordingly, WPA 18259 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
