This instant writ petition is presented seeking a directive to the learned Tribunal to expedite the disposal of the original application (in short, OA), being OA-119 of 2020. Mr. Mishra, learned advocate representing the petitioner submits that the petitioner is a physically challenged individual who approached the learned Tribunal for resolution of an issue regarding his promotion. He submits that the parties have already exchange their affidavits and the written notes of argument also have been exchanged between the parties but following the transfer of a member of the learned Tribunal, the matter could not be finally decided. He further submits that the matter was adjourned on several occasions.

He expresses his apprehension that although the matter is scheduled to be listed on the next date, i.e., September 24, 2024 but due to congestion in the docket of the learned Tribunal, there is little possibility of the matter being taken up and it may again be deferred to another date.

The learned advocates representing the respondents have left the matter to the discretion of this Court.

In this context, having regard to the submissions made by the respective parties and considering the materials on record, the writ petition is disposed of by directing the learned Tribunal to make a sincere endeavor to dispose of the OA, on the returnable date, i.e., on September 24, 2024, or as expeditiously as possible, preferably within eight weeks after the ensuing vacation.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
