On the basis of the submissions made by the learned advocate for the petitioner, the release of unpaid retiral benefits and interest on delayed payment of retirement benefits of the petitioner was allowed and the writ petition was disposed of. However, at the time of signing the order when the averments in the writ petition was scrutinized minutely it was found that the averments made in the writ petition did not tally with the submissions made in Court by the learned advocate while the matter was taken up for consideration. Moreover, the learned advocate had placed before the Court a chart to give the date of retirement, the date on which the benefits were actually given and the delay in paying the retiral

benefits. The chart also did not tally with the writ petition and the submissions made by the learned advocate at the time when the matter was taken up for consideration.

This Court had time and again cautioned the learned advocate to be more careful in this type of matters as even in few earlier occasions the same thing happened in respect of similar matters.

In the aforesaid facts and circumstances, the said order was not signed and the matter has been brought into the list.

The writ petition is dismissed with costs assessed at Rs. 5,000/-. The costs have to be paid to the High Court Legal Services Committee. The payment of costs shall be a pre-condition for filing any further application on the self-same cause by the writ petitioner. (Arindam Mukherjee, J.)
