The limited prayer of the writ petitioner is that a representation made to the Secretary, State Transport Authority and various other officers on 1st March, 2021 with regard to adjustment of Motor Vehicle Tax and Additional Road Tax has not been responded till date. Learned counsel appearing for the State submits that the designated authority to consider such request is the Additional Secretary, Transport Department, Government of West Bengal, who is in-charge of Motor Vehicle Taxes.

W.P.A.19379 of 2021 is accordingly disposed of with a direction on the authority mentioned above to consider and dispose of the representation of the petitioner within a period of four weeks from date by passing a reasoned order upon hearing all concerned

parties including the petitioner in accordance with law. The copy of the reasoned order shall be made available to the petitioner within four days from date of such order.

Since affidavits have not been called for, the allegations made in the writ petition shall be deemed not to have been admitted.

In the event, the petitioner seeks to apply further points for consideration, the petitioner shall be at liberty to do so and the concerned authority shall dispose of the representation along with the additional points within four weeks from the date on which the final representation and the additional points have received by the authority.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
