Initially, the petitioner's application for electricity service connection was refused. The matter came up before this court twice and ultimately it was directed that a metered connection be given to the petitioner.

However, due to resistance by the private respondent, the said connection cannot be given by the CESC Limited as per the version of the petitioner as well as the CESC Limited.

Despite service, none appears for the private respondent at the time of call.

Accordingly, keeping in view the above factual circumstances of the case, WPA No. 18273 of

2023 is allowed, thereby directing the CESC Limited to give a new electricity metered connection to the petitioner at the existing meter board position of the premises-in-question within a fortnight from date.

In the event any obstruction is raised by the private respondent no.5 and/or his men and agents in doing so, the CESC Limited personnel shall be at liberty to approach respondent no. 4, the Officer-in-Charge, Chatterjeehat Police Station for adequate police assistance which, upon such approach being made, shall be given by the respondent no.4 at the cost of the petitioner by acting on a server copy of this order without insisting upon prior production of a certified copy thereof. In the event any padlock or other hindrance is put up by the private respondent to resist the CESC Limited personnel, it will be open to the police to break open such padlock or remove such hindrance for the limited purpose as indicated above.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
