Report submitted by the learned advocate appearing for the State be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is unable to reside at her residence which is within the jurisdiction of Berhampore Police Station.

Learned advocate for the private respondent nos. 7 to 11 is present.

It has been categorically stated in the report submitted by the State that if the petitioner comes at police station and seeks any legal assistance, the same would be rendered by Berhampore Police Station. In view of the specific assertion made by the Inspector-in-Charge, Berhampore Police Station, Murshidabad Police District, I am of the view that until and unless the petitioner goes and approach the police authorities and enters the residence, no relief as sought for can be granted.

Accordingly, the petitioner submits that she will go to Berhampore Police Station on 29.09.2024 between 10 a.m. to 2 p.m. and would seek for police assistance to enter her residence.

The police authorities, as they have expressed their intention, would render assistance to the petitioner and ensure that the egress and ingress of the petitioner and/or her further stay is not hampered and/or she is harassed at her residence or there is any breach of peace or tranquillity at the locale after the petitioner enters her residence. However, the police authorities are directed that they would see the aforesaid prayer of the petitioner as an issue relating to law and order problem and/or preventive measures of the police authorities. If any police picket is prayed for, the police authorities would, if possible, grant the same on usual charges being paid by the petitioner. With the aforesaid observations, the writ petition being WPA 19112 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
