The petitioner applied for compassionate employment on account of service of his father, Janakinath Mahata, who died as an Assistant Teacher of Motgoda Primary School under Raipur Circle, Bankura on 10.01.2020.

The application of the petitioner was considered and the petitioner was asked by the DPSC, Bankura to submit certain documents. There was mismatch in the name of the daughter of the deceased teacher between the legal heir certificate issued by the D.M., Bankura and the NOC affirmed before the learned Judicial Magistrate (First Class), Jhargram.

The matter has been referred by the DPSC, Bankura to the D. I. of Schools (SE), Bankura for further action.

This Court notes that the sister of the petitioner might have got married since after the death of her father.

In those circumstances, the D. I. of Schools (PE), Bankura shall take a decision on the petitioner's application for compassionate employment and pass appropriate orders positively within a period of two months from the date of receipt of a copy of this order.

The petitioner shall be entitled to clarify any discrepancy as indicated hereinabove to the D. I. of Schools (PE), Bankura by way of a written representation.

The writ petition is disposed of.

8.

A report of the DPSC, Bankura is kept with the record.

9.

There will be no order as to costs.

10. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
