1. The petitioners seek payment for successful completion of work. It is submitted that part payment has been made but the final bill is yet to be disbursed.

2. Legal representation on behalf of the petitioners is pending consideration before the respondent authority.

3. None appears on behalf of the State.

4. Affidavit-of-service filed in Court today be kept with the records.

5. In the absence of any representation from the State, the Court is not in a position to decide the issue conclusively.

6. In view of the above, the instant writ petition is disposed of by directing the Block Development Officer, Sagardighi being the respondent no. 3 herein to consider and dispose of the legal representation filed on behalf of the petitioners in accordance with law after giving reasonable opportunity of hearing to the representative of the petitioners at the earliest but positively

within a period of twelve weeks from the date of communication of this order.

7. If any amount is found due and payable, the same shall be disbursed in favour of the petitioners without any further delay subject to compliance of all necessary formalities.

8. Learned advocate for the petitioners is directed to forward a copy of the pending bills and all other supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

9. The writ petition stands disposed of.

3. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
