For the Respondents Learned counsel appearing for the appellant has fairly submitted that the appeal lies before the city civil court and accordingly leave is granted to the appellant to withdraw the appeal and present the same before the city civil court. Since the appeal is not maintainable before this Court, the department is directed to return the certified copy of the impugned order to the learned advocate on record for the appellant upon furnishing the phtostat copy of the same. In view of the submission of the appellant, the appeal is dismissed as withdrawn.

In view of the dismissal of the appeal, CAN 1 of 2021 has become infructuous and the same accordingly is disposed of.
