The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The instant application under Article 227 of the Constitution of India is at the instance of the plaintiff in Title Suit No. 234 of 2019 pending before the 1st Court of the learned Civil Judge (Junior Division), Barrackpore, District : 24Parganas (North). The petitioner is complaining delay in disposal of the applications under Sections 7(1) and 7(2) of the West Bengal Premises Tenancy Act, 1997 filed by the defendants, the opposite parties herein. It appears from record that the said application was filed way back in January 03, 2020.

Section 7(2) of the said Act of 1997 mandates that an application under the said provision of the said Act is required to be disposed of as soon as possible, not exceeding one year from the date of its filing, therefore, the learned Trial Judge is requested to make all endeavour to dispose it of as expeditiously as possible and in doing so shall grant any unnecessary adjournment to either of the parties. C.O. 2683 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
