Perused the report of Officer-in-Charge, Hare Street Police Station dated 4th January, 2024 submitted by the State-respondents. Such report is taken on record. Mr. Somenath Ganguli, learned advocate for the State respondents submits that pursuant to the order of this Court specific case has already been initiated at Hare Street Police Station against the petitioner nos. 2 & 3, and the investigation is in progress.
It surfaced during the hearing of the writ petition that the petitioner nos. 2 & 3 forged the signature of the petitioner no.4 in the vakalatnama filed in the writ petition. Accordingly, the learned Registrar General, High Court, Calcutta by order dated 18th December, 2023 was directed to take steps for making complaint before the
appropriate authority. In compliance thereof, the learned Registrar General, High Court, Calcutta vide Memo no. 11621-RG dated 19th December, 2023 sent a letter to the Officer-in-Charge, Hare Street Police Station, for lodging a complaint. The report of Officer-in-Charge, Hare Street Police Station shows that a complaint has been lodged and specific case being Hare Street P.S. Case No. 335 dated 30th December, under Sections 205/465/120B of the Indian Penal Code has been initiated against the petitioner no.2 Sambhu Nath Moulick and petitioner no.3 Kashi Nath Moulick. Bearing in mind the conduct of petitioner nos.2 & 3 as above, the writ petition is liable to be dismissed. In the aforesaid backdrop, the writ petition being no. W.P.A. 18313 of 2023 stands dismissed.
All connected applications, if any, also stands dismissed.
Interim order, if any, stands vacated.
There will be, however, no order as to costs. Urgent photostat copy of this order, if applied for, be given to the parties upon compliance of necessary legal formalities.
