Learned advocate appearing for the petitioner submits that petitioner is in custody for 3 years and 5 months and prosecution intends to examine 79 witnesses out of which 8 witnesses have been examined.

There is no possibility of the trial concluding, as such on any stringent condition petitioner may be released on bail. Learned advocate for the State submits that two persons were murdered in course of dacoity and so far as the present

petitioner is concerned there were recoveries of jewellery from his house.

It has also been pointed out that the cause of delay is continuous deferring of cross-examination at the behest of the accused persons. It has also been stated that the prosecution would reduce the number of witnesses to 30.

Having regard to the circumstances pointed out, at this stage, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 1333 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
