Affidavit of service filed on behalf of the petitioner be kept with the record.

The petitioner participated in the selection process for filing up the vacancy of the post of nonteaching staff in Secondary School, but was unsuccessful.

The petitioner moved a writ petition being WP No. 16089 (W) of 2019 for consideration of his candidature in the said selection process. A Coordinate Bench of this Court disposed of the said writ petition with the following direction vide order dated March 04, 2020:- "The Secretary, West Bengal Central School Service Commission is requested to consider the candidature of the petitioner by considering the writ petitioner as the said application is filed before him.

Learned Advocate on record of the petitioner is requested to serve a copy of this writ petition along with a copy of the order of this Court before him positively within a week from today.

The Secretary, West Bengal Central School Service Commission will consider the application of the petitioner at an earliest preferably within a period of 12 (twelve) weeks from today."

The petitioner did not avail the opportunity granted to him by the aforesaid order and by the present is praying a similar direction upon the secretary WBCSSC.

Mr. Rudranil De, learned counsel for the petitioner, submits that the petitioner due to various unavoidable reasons could not approach the Secretary of the Commission in terms of the order passed in the earlier writ petition as such he is praying for a similar direction.

Dr. Sutanu Kumar Patra, learned counsel for the Commission, submits that the selection process in which the petitioner participated was for the year 2016 and the said process was completed in the year 2019 and the panel has already expired, therefore, there is no scope for consideration of the candidature of the petitioner.

The prayer of the petitioner for enlargement of time to consider the candidature of the petitioner, in view of the development subsequent to the order passed in the earlier writ petition has become infructuous as such WPA 18689 of 2022 is dismissed without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
