For the Petitioner Learned Advocate for the petitioner is aggrieved by the manner in which the proceedings under Section 12 of the PWDV Act, 2005 in Misc. Case No. 205 of 2021 is progressing before the Learned Judicial Magistrate at Tamluk, presently pending before the Learned Judicial Magistrate, Contai, being, Misc. (DV) 325 of 2021. The grievance of the petitioner is that, till date, she did not receive an opportunity of effective hearing in respect of the proceedings.

However, dates have been fixed for the last two years, but, nothing has progressed.

Having considered the plight expressed by the petitioner, I direct that the Learned Judicial Magistrate, 3rd Court, Contai, would, within three months from the date of communication of this order, hear out the application for interim relief, prayed for by the petitioner.

The Learned Magistrate would take steps so that on or before 30th of November, 2023, there are directions in respect of the interim relief, sought for by the petitioner. With the above observations, CRR 2861 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
