The report indicates that the second and third floors of the relevant building were constructed without an approved plan.

The attention of this Court has been drawn to the order passed by the Coordinate Bench of this Court on April 26, 2023, in WPA 5530 of 2022. A contempt application (CPAN 526 of 2024) has also been filed seeking the implementation of the said order. The learned advocate for the petitioner submits that, in accordance with the order dated April 26, 2023, no inspection was conducted by the Howrah Municipal Corporation. Furthermore, it has been contended that the petitioner, who is the owner of the second floor, was not notified when the order dated April 26, 2023, in

WPA 5530 of 2022 was issued.

This Court is unable to entertain the issues raised by the petitioner, as a Coordinate Bench is currently hearing the contempt application (CPAN 526 of 2024) concerning the alleged violation of the order dated April 26, 2023, in WPA 5530 of 2022. Accordingly, this writ petition is dismissed.

The dismissal of this petition shall not preclude the petitioner from filing an appropriate application before the Hon'ble Single Judge who is hearing CPAN 526 of 2024.

WPA 18926 of 2024 along with CAN 1/2024 is dismissed.
