The grievance of the petitioner is directed against failure of respondent no. 4 to handover possession of a premises in terms of a tender dated August 8, 2019.

It is submitted on behalf of the petitioner that despite having deposited a sum of Rs.2 lakhs and being the successful bidder, the respondent authorities have deliberately failed and neglected to handover the premises to the petitioner in terms of the above tender.

The State and respondent no. 3 are represented and submit that they have no objection if the representation dated June 21, 2023 is decided by the concerned District Engineer being the respondent no.

in accordance with law.

In view of the above, WPA 18321 of 2023 stands disposed of by directing the respondent no. 4 to consider and dispose of the grievance of the petitioner morefully enumerated in the letter dated June 21, 2023 being annexure 'P-7' to the writ petition within a period of six weeks from the date of communication of this order after giving a right of hearing to all the affected parties. With the above directions, WPA 18321 of 2023 stands disposed of.

In considering the above representation, the respondent no. 4 shall not be influenced by any observation or finding in this order and shall dispose of the same in accordance with law.
