The present application was for transfer under Section 407 of the Code of Criminal Procedure in respect of a proceedings under Section 125 of the Code of Criminal Procedure being M.C Case No. 304 of 2009 pending before the learned Additional Judicial Magistrate, Hooghly. The present application was admitted on 28th July, 2010 wherein an interim order was passed for a limited period of six week with liberty to pray for extension. However, the application never appeared or was listed. Learned advocate is unable to apprise this court regarding the present stage of the proceedings.

Having regard to the same, I am of the opinion that the revisional application is disposed of with the direction that if circumstance so warrants and the main proceedings are still pending before the jurisdictional court, the petitioner would be at liberty to approach this court afresh.

Accordingly, the revisional application being CRR 2228 of 2010 is disposed of.
